Frequently Asked Questions (FAQs)

Who is responsible to maintain a private road?
Responsibility for maintaining a private road is born on the owners that abut / use this road. A private road easement and maintenance agreement is typically filed on the deed of a lot that has its access / egress from a private road. (Note. The Highway Department of this town is not responsible for any maintenance to a private road, including but not limited to drainage, ice/snow removal, and signage.)

Who is responsible to maintain streams on private property?
The owner of the land where a stream is located is responsible to maintain a stream / watercourse. The Highway Department of this town is only responsible for portions of a stream / watercourse located within the town's highway right-of-way. You can read more at Guidelines for Managing Debris in Streams and Rivers

Is approval required to work within the right-of-way of a state, county and/or town highway?
Working within a highway right-of-way (ROW) requires strict adherence to applicable regulations as well as necessitating a permit from the authority having jurisdiction (e.g., NYSDOT, County Highway Superintendent, or Town Highway Superintendent) for any construction, excavation, or improvement. The ROW typically encompasses the land used by the municipality for the road, ditches, and utilities. Unauthorized obstructions, driveways, or utility work can be fined, and improper work must be repaired at the owner's expense.

Does the Highway Department collect brush, branches, branches and other yard trimmings/waste?
No. Property owners are responsible for disposing of these items in an approved manner. Yates County provides information on how to properly dispose of yard trimmings/waste at Yates County Information for Recycling and Yard Waste
