Department Mission:
The mission of this department is to provide quality service to the citizens and businesses of the Town of Milo, outside the Village of Penn Yan, relating to building construction, fire and life safety, property maintenance and land development and use (e.g., zoning) issues.

Department Goals:
This department’s goals for the accomplishment of our mission are as follows:
Provide prompt, courteous and professional service;
Inform the public of various code laws and to work cooperatively to achieve voluntary compliance;
Administer and enforce laws such as but not limited to building construction, fire prevention, flood damage prevention, property maintenance as well as land development and use (e.g., zoning);
Provide staff assistance and counsel to the Legislative Advisory Committee, Planning Board and Zoning Board of Appeals; and
Perform other duties as may be directed by law and/or the Town Board.
Who needs codes? We all do - whether in our homes, offices, schools, stores, factories, or places of entertainment. We rely on the safety of structures that surround us in our everyday living. The public need for protection from disaster due to fire, structural collapse, and general deterioration but also to help preserve property values from threats (e.g., blight) underscores the need for modern codes and their administration.
Why should codes apply to my own house? Codes apply to your house for several reasons, which are (1) for your personal safety, and that of your family, and the guests invited into your home; (2) to ensure the economic well-being of the community by reducing potential spread of fire, disease and blight; (3) for the conservation of energy; and (4) to protect future purchasers who deserve reasonable assurance that the home they buy will be safe. When do I need a Building Permit? The best way to find out if you need a Building Permit is to call our department. It is always best to discuss your plans with the Code Enforcement Officer before beginning construction to determine whether you need a Building Permit. Even if a Building Permit is not needed, the Code Enforcement Officer will answer construction questions and may provide valuable advice. What is the licensing requirements for contractors? New York State does not issue a uniform, statewide license for contractors. The Attorney General of NYS has a tip sheet for owners when selecting their contractor, which is available at Hiring a Home Improvement Contractor. Furthermore, this town is not responsible for problems caused by contractors. Instead, the owner is responsible for ensuring their property and/or structures are safe, the proper permits are pulled, and that they are hiring a qualified professional.
How can I obtain a copy of the NYS Uniform Fire Prevention and Building Codes as well as the NYS Energy Conservation Construction Code? These state codes can be purchased through various online vendors such as but not limited to Amazon. However, please make sure you are purchasing the current edition adopted by NYS. How can I file a complaint? A person can file a complaint with this department by completing the Complaint of Violation form available by clicking the following weblink: Complaint of Violation Form. You will need the address of the property you are complaining about, a description of the violation, the location of the violation on the property and you will need to give your name, address and phone number for a complaint to be taken. Furthermore, you will need to sign this form. Please understand that this department does not accept anonymous complaints unless there exists imminent danger, which is defined by the NYS Uniform Fire Prevention and Building Code. Furthermore, please comprehend that our staff cannot enter private property without permission from the owner or person legally occupying a structure. Therefore, the Code Enforcement Officer would need to observe the alleged violation from a public way (i.e., public road) if permission to enter the private property is not given/obtained. Lastly, noise complaints are handled by law enforcement agencies such as the NYS Police and Yates County Sheriff.

How / Where can I obtain the survey for my lot? A title survey is often included in the closing documents of your lot to confirm boundary lines, easements, and encroachments. Therefore, it is strongly recommneded that you find and review these documents. If you cannot find this survey within such documents, surveys in New York State are required to be filed with the county clerk in accordance with § 334 of the Real Property Law of NYS.
